DISPUTES REGARDING PERSONAL DATA COMPLAINTS
A. Complaint Process

We commit to providing a response within a reasonable timeframe, not exceeding 60 days. Should the complaint remain unresolved through our internal processes, V360 will initiate an Arbitration process as outlined below.
B. Good Faith Negotiation; Arbitration
If a dispute is not resolved through good faith negotiations between you and the Company, Voice 360 will offer, free of charge, an accessible and independent dispute resolution through a service provider located in Palm Beach County, Florida. If this does not lead to a satisfactory resolution, either party may choose to resolve the dispute via a neutral, binding, non-appearance-based arbitration under the Commercial Rules of the American Arbitration Association, conducted in Palm Beach County, Florida. The arbitration will adhere to the following procedures: (a) the arbitration may be conducted, at the discretion of the party seeking relief, via telephone, online, or based solely on written submissions; (b) personal appearances by the parties or witnesses will not be required unless mutually agreed upon; and (c) any arbitration award may be entered into a court of competent jurisdiction.
The parties acknowledge and agree that the dispute resolution process results in each party waiving the right to a jury trial for all issues. Each party explicitly waives the right to a jury trial concerning any disputes arising out of or related to the terms and conditions of this agreement.
C. No Class Actions
You and Voice 360 agree that disputes must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. Furthermore, the arbitrator cannot consolidate more than one person’s claims or preside over any form of a representative or class proceeding.
D. Cause of Action
You agree that notwithstanding any statute or law to the contrary, any claim or cause of action arising from or related to this Agreement must be filed within one (1) year after such claim or cause of action arose, or it will be permanently barred.
CHANGES TO THIS PRIVACY POLICY
We may update this Privacy Policy periodically. Changes will be posted with the updated effective date. Users should review this policy regularly.
