These Terms of Service (“Terms”) govern your use of our interactive subscription membership site, Voice 360 (“V360,” “we,” “us,” or “our”), which includes access to our video library of voice lesson courses, worksheets, quizzes, and other related content (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Services.
F. Refund Policy
Voice 360 offers a 3-day refund policy. If you are dissatisfied with your membership within 3 days of purchase, you can contact our customer support team at: info@Voice-360.com for a refund. Refunds will not be issued after this period.
G. Promotions and Coupon Codes
Promotions and Coupon Codes can only be used once and cannot be exchanged for cash. There may be certain restrictions set by V360 on any and all promotions and coupon codes.
B. Content Restrictions
You agree not to upload, post, or submit any content that is illegal, offensive, defamatory, harmful, or infringes on the intellectual property rights of any third party.
C. User Content Removal
Voice 360 reserves the right to remove or modify any User Content that violates these Terms or is deemed inappropriate, in our sole discretion.
7. Intellectual Property
A. Ownership of Content
The Services, including all video lessons, quizzes, worksheets, and other materials, are the exclusive intellectual property of Voice 360 or its licensors and are protected by copyright, trademark, and other intellectual property laws.
B. Usage Rights
You are granted a limited, non-exclusive, non-transferable license to access and use the V360 Content solely for your personal, non-commercial use during the term of your subscription.
C. Restrictions
You may not copy, reproduce, distribute, modify, or create derivative works of the content available through the Services without prior written consent from Voice 360.
8. Third-Party Links
Our Services may contain links to third-party websites that are not owned or controlled by Voice 360. We do not control, endorse, or assume responsibility for any third-party websites, content, or services. You access these links at your own risk.
9. Termination
A. Termination by Voice 360
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, you will lose access to the Services and any content or benefits associated with your account.
B. Termination by You
You may cancel your subscription at any time by contacting us using this link or emailing us at: info@Voice-360.com . Your cancellation will take effect at the end of the current billing cycle.
10. Indemnification
You agree to indemnify and hold harmless Voice 360, its affiliates, owners, employees, agents, and representatives from any claims, damages, losses, or expenses (including legal fees) arising out of or related to your use of the Services, violation of these Terms, or infringement of any intellectual property rights.
11. Limitation of Liability
In no event shall Voice 360 be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Services, including but not limited to loss of profits, data, or business opportunities. The total liability of Voice 360 shall be limited to the amount you paid for your subscription in the last 1 month.
12. Disclaimer
The Services are provided “as is” and “as available.” Voice 360 makes no representations or warranties regarding the availability, accuracy, reliability, or quality of the Services. You acknowledge that your use of the Services is at your own risk.
13. Governing Law
These Terms and your use of the Services will be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of laws principles. Any disputes arising from these Terms shall be resolved in the courts located in Palm Beach County, Florida.
14. Dispute Resolution
A. Complaint Process
Individuals may submit complaints concerning Voice 360’s use of Personal Data, or any other issues related to this Privacy Policy, by contacting our Customer Service department at: info@Voice-360.com. We commit to providing a response within a reasonable timeframe, not exceeding 60 days. Should the complaint remain unresolved through our internal processes, V360 will initiate an Arbitration process as outlined below.
B. Good Faith Negotiation; Arbitration
If a dispute is not resolved through good faith negotiations between you and the Company, Voice 360 will offer, free of charge, an accessible and independent dispute resolution through a service provider located in Palm Beach County, Florida. If this does not lead to a satisfactory resolution, either party may choose to resolve the dispute via a neutral, binding, non-appearance-based arbitration under the Commercial Rules of the American Arbitration Association, conducted in Palm Beach County, Florida. The arbitration will adhere to the following procedures: (a) the arbitration may be conducted, at the discretion of the party seeking relief, via telephone, online, or based solely on written submissions; (b) personal appearances by the parties or witnesses will not be required unless mutually agreed upon; and (c) any arbitration award may be entered into a court of competent jurisdiction.
The parties acknowledge and agree that the dispute resolution process results in each party waiving the right to a jury trial for all issues. Each party explicitly waives the right to a jury trial concerning any disputes arising out of or related to the terms and conditions of this agreement.
C. No Class Actions
You and Voice 360 agree that disputes must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. Furthermore, the arbitrator cannot consolidate more than one person’s claims or preside over any form of a representative or class proceeding.
D. Cause of Action
You agree that notwithstanding any statute or law to the contrary, any claim or cause of action arising from or related to this Agreement must be filed within one (1) year after such claim or cause of action arose, or it will be permanently barred.
15. Entire Agreement
This Agreement encompasses the complete understanding between the parties regarding the subject matter addressed. Any changes or modifications to this Agreement can only be made as specified within this document.
16. Binding Effect
This Agreement shall be binding on the assigns, heirs, executors, affiliates, agents, personal representatives, administrators, and successors of each party, whether through merger, operation of law, or other means.
17. Headings
The titles and headings included in this Agreement are solely for convenience and should not be taken into account when interpreting or construing the terms of this Agreement.
18. No Waiver
Failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision in the future.
19. Severability
If any provision of these Terms is found to be invalid, the remaining provisions will remain in full force and effect.
20. Changes to These Terms
We may update these Terms from time to time. Any changes will be posted on the website, and your continued use of the Services after such changes constitutes your acceptance of the updated Terms.
